1. Services
WIA Digital provides lead generation, marketing management, and growth consulting services to business clients. The specific scope, timeline, pricing, and deliverables for any engagement are defined in a separate client agreement or statement of work executed by both parties. These Terms of Service govern the general relationship between WIA Digital and all clients and website visitors.
2. Eligibility
Our services are intended for business use by individuals who are at least 18 years of age and are authorized to enter into binding agreements on behalf of themselves or their organization. By engaging our services, you represent that you meet these requirements.
3. Payment Terms
Payment terms are specified in each client agreement. Invoices are due upon the date indicated. WIA Digital reserves the right to pause or terminate active services for any account with an outstanding balance more than 15 days past the due date. Reactivation of paused services may require payment of outstanding amounts in full before work resumes.
4. Intellectual Property
All deliverables produced by WIA Digital — including copy, strategy documents, creative assets, and campaign materials — become the property of the client upon receipt of full payment for the applicable engagement. Prior to full payment, all work product remains the property of WIA Digital. WIA Digital retains the right to reference completed engagements for portfolio, case study, and marketing purposes unless the client submits a written request to opt out.
5. Confidentiality
WIA Digital treats all client business information as confidential. We will not disclose proprietary information, business data, or client strategies to any third party without explicit written consent from the client, except as required by law or legal process. This obligation survives the termination of any service agreement.
6. Client Responsibilities
Clients are responsible for providing accurate and complete information necessary for WIA Digital to perform services. Delays caused by late delivery of required materials, approvals, or feedback from the client may result in adjusted timelines at no fault of WIA Digital.
7. Limitation of Liability
WIA Digital is not liable for indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to lost revenue, lost profits, or business interruption. Our total liability to any client for any claim arising out of or relating to our services is limited to the total amount paid by that client for the specific service giving rise to the claim in the 90 days preceding the claim.
8. No Guarantee of Results
WIA Digital will make every reasonable effort to achieve the outcomes outlined in each engagement. However, marketing and lead generation results depend on many factors outside our control, including market conditions, client responsiveness, and competitive environment. We do not guarantee specific revenue, lead volume, or conversion outcomes.
9. Termination
Either party may terminate a service agreement with 14 days written notice delivered by email. Upon termination, the client is responsible for fees covering all work completed up to the termination date. WIA Digital will deliver all completed work product upon receipt of any outstanding payment.
10. Website Use
You may use this website for lawful purposes only. You may not attempt to gain unauthorized access to any part of the site, transmit malicious code, or use the site in any way that could damage or impair its functionality. We reserve the right to restrict access to the site at our discretion.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in Sacramento County, California.
12. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our site or services after any changes constitutes acceptance of the revised terms.
